Depending upon the circumstances, a party may be awarded parental rights, including the ability to receive child support, make decisions on the child’s behalf, and have a parenting plan put in place. This is true even if the biological parents still have legal parental rights to the child and do not agree to a third party establishing parental rights. Non-biological parents need to have an order put in place so that they would then have the legal authority to make decisions regarding the minor child. Colorado statutes provide guidance on how a Court can issue an order to accomplish this. But the process can be complicated and a knowledgeable child custody attorney is critical to ensure the Court has the information necessary to issue and order that is in the child’s best interest.
