A probate procedure is the legal process by which a decedent estate passes to his heirs. Probate is required in Colorado if a decedent owns any interest in real property, regardless of its value, or if the value of the decedent’s estate exceeds a certain dollar amount. It is important a probate estate is administered properly as the estate administrator (personal representative) could be found responsible and ultimately liable to creditor of the estate. It is equally important for the heirs of the estate to make sure the estate is administered properly as this could have a direct impact upon their inheritance, if any.
